Terms of Service

1. About these terms

By using twig.tools (the “Service”, “we”, “us”, or “our”), you are agreeing to be bound by the following terms and conditions (the “Terms of Service” or “Terms”). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates, and all users who access the Service through your account to these Terms, in which case the terms “you” or “your” shall refer to such entity, its affiliates, and users associated with it. If you do not have such authority, or if you do not agree with these Terms, you must not accept this agreement and may not use the Service.

2. The Service

twig.tools is a web-based bookmark, tag, and note management application. We may modify, add, or remove features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time.

3. Your account

  • You must be at least 16 years old to create an account.
  • You must provide accurate information and keep your login credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account by emailing twig.tools.community@gmail.com.

4. Your content

You retain all rights in the bookmarks, tags, notes, and other content you upload or create (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely to operate and provide the Service to you. This licence ends when you delete Your Content or close your account, except to the extent retention is required by law or for legitimate backup purposes.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to store, transmit, or link to unlawful content.
  • Upload material that infringes third-party intellectual property or privacy rights.
  • Attempt to gain unauthorised access to the Service, other users’ accounts, or our systems.
  • Probe, scan, or test the vulnerability of the Service except under a documented security disclosure programme.
  • Use the Service to send spam, malware, or any harmful or deceptive content.
  • Resell, sublicense, or operate the Service on behalf of third parties without our written consent.
  • Use automated means (bots, scrapers) to access the Service in a way that imposes unreasonable load.

We may suspend or terminate accounts that breach this section without notice.

6. Subscriptions and billing

  • The Service is offered on a free tier and on paid subscription plans. Current prices are shown on the Pricing page.
  • Payments are processed by Stripe. By subscribing you authorise us to charge the payment method on file at the start of each billing period.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period.
  • If a payment fails we may suspend access to paid features until the balance is settled.
  • Prices may change. We will give you at least 30 days’ notice before any price change affects your subscription, and you may cancel before the new price takes effect.

7. Refunds and cooling-off

Our refund position is set out in full in the Refund Policy, which forms part of these Terms.

Express consent — UK/EU consumers. Access to the Service begins immediately on successful payment so that you can use it straight away. By subscribing you expressly request immediate performance of the contract and acknowledge that you lose your statutory right to cancel under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (and equivalent EU implementing legislation) once performance has begun.

8. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.

9. Intellectual property

The Service, including its software, design, logos, and content (other than Your Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

10. Service availability and warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements, that it will be secure or uninterrupted, or that defects will be corrected.

11. Limitation of liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.

Subject to the above, to the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill.
  • Our total aggregate liability arising out of or in connection with the Service is capped at the greater of (a) the total amounts paid by you to us in the 12 months preceding the event giving rise to the claim, or (b) GBP 50.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or Your Content.

13. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and we may delete Your Content after a reasonable retention period as described in the Privacy Policy. Sections that by their nature should survive termination (including sections 4, 10, 11, 12, 15) shall do so.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify you by email or via the Service at least 14 days before it takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that if you are a consumer resident in another jurisdiction you may also bring proceedings in the courts of your country of residence.
